Netcapital Financial Group, in accordance with the laws of Mongolia and the General Data Protection Regulation (hereinafter referred to as “GDPR”) issued by the European Union, which is followed in most countries of the world, aims to provide you with transparent, detailed and accessible information about the purposes for which and how information is obtained, collected, processed, used, disclosed to others, stored and protected from your customers through this Personal Data Privacy Policy.
WHAT IS PERSONAL INFORMATION?
Personal information is understood to mean sensitive personal information and other information that directly or indirectly identifies or can identify a person, such as a person's father's/mother's name, first name, date of birth, place of birth, address, location, civil registration number, assets, education, membership, electronic identifiers, and other information that can directly or indirectly identify or identify a person.

GRANTING AND WITHDRAWING CONSENT
Netcapital Financial Group will only enter into a contract and provide products and services if the customer registers as a customer at their own request, expresses a request to receive products and services from Netcapital Financial Group, and agrees to the terms and conditions of the contract and provides the necessary accurate information to Netcapital Financial Group.
If the Customer does not accept the terms and conditions of the agreement before entering into an agreement with Netcapital Financial Group, Netcapital Financial Group will refuse to provide services. If the Customer fails to update his/her information in accordance with applicable laws or provides false information or documents, Netcapital Financial Group will refuse to provide services if it is determined through relevant inspections by Netcapital Financial Group.
FOR WHAT PURPOSES DO WE COLLECT, PROCESS AND USE YOUR INFORMATION?
Netcapital Financial Group, with your consent as a customer and in accordance with the requirements of the Civil Code of Mongolia, the Law on Deposits, Transfers of Funds and Credit Activities of Banks and Authorized Legal Entities, the Law on Combating Money Laundering and Financing of Terrorism, and other laws issued in accordance with them, collects, processes and uses your Personal Information to calculate and conduct creditworthiness research, offer you tailored services, improve and develop our products and services, provide you with product, service and account information, resolve complaints, assess risks, ensure data security, ensure compliance, settle payments, prevent money laundering, financing of terrorism, and proliferation of weapons of mass destruction, fulfill legal and reporting obligations, and conduct data analysis and auditing.
HOW DO WE COLLECT PERSONAL INFORMATION?
We collect your Personal Information and other information necessary to deliver products and services from the forms, requests, applications, contracts, other documents you submit when registering as a customer and when purchasing group products and services, mobile applications, and other sources permitted by you and applicable laws.
WHAT INFORMATION ABOUT YOU DO WE PROCESS?
We may lawfully obtain and process the following information about you, and in doing so, we will comply with the principles and requirements set forth in applicable laws:
- Your Personal Information, ethnicity, marital status, age, gender, income and expenditure information;
- Documents provided to verify personal information (photo, ID card, passport, birth certificate, reference, description, etc.);
- Transaction information and account statements;
- Financial information and business history;
- Information obtained using surveillance camera footage and other electronic means;
- Device and IP address used for the purpose of using the Group's products and services and for location purposes.
USE, STORAGE AND DELETION OF PERSONAL INFORMATION
We will collect your personal information from you in accordance with applicable Mongolian laws, the Group's internal policies and procedures, general terms of service, and GDPR standards and will retain it for a period not less than the period specified in applicable Mongolian laws and until the information is no longer required for use. We will store, archive, and delete personal information in accordance with the Group's "Archive Operations Procedures", "Information Security Procedures", and "Information Classification Procedures".
REQUEST FOR PERSONAL INFORMATION
The Group collects personal information from customers and delivers products and services in accordance with applicable laws and regulations, with the customer's consent. At the customer's request, the Group can provide information about what types of personal information Netcapital Financial Group holds about them. Customers can submit their requests in writing to the branch.
The Group will carefully review the written request from the customer and, upon verification of the customer's identity, provide the customer with relevant information in accordance with the Group's "Information Security Procedures".
INFORMATION SECURITY
- The Company is obligated by applicable Mongolian laws not to disclose your personal information except as required by law.
- Even after a customer closes their account, the confidentiality of customer information will continue to be maintained in accordance with the law.
- The Group implements all technical and process security measures in accordance with applicable laws and regulations to protect the confidentiality of its customers' information.
- The Group implements the International Information Security Standard ISO27001:2013 and best practices in its operations.
WITH WHOM DO WE SHARE YOUR INFORMATION?
The Group is obliged to provide your information to the following competent regulatory and law enforcement authorities in accordance with the laws of Mongolia, the regulations issued in accordance with them, and the GDPR standards. These include:
- Based on the official number of any court, prosecutor's office, law enforcement agency, court enforcement office, and their authorized officials;
- Based on the official requirements related to the implementation of the functions of the competent regulatory body;
- Reporting in accordance with legal obligations related to the prevention of money laundering and financial crimes
- Mongolian Bank Loan Database
- On other grounds and requirements specified by law;
WHAT ARE YOUR RESPONSIBILITIES?
You are responsible for not disclosing, transferring, or allowing others to lose your login name, password, secret question, and answer that you created when using the Group's services. The Group is not responsible for any loss or damage caused by your loss of your password.
CONTROL AND IMPLEMENTATION
The Manager in charge of the Information Security and Data Privacy Department and the Director of Risk Management are responsible for the implementation and monitoring of information security and data privacy within the framework of ISO27001:2013; and GDPR.
